These Terms and Conditions (“Terms”) govern access to and use of:
www.ofthewest.co
www.jobsofthewest.co
Any related subdomains, applications, services, and hiring marketplace functionality
(collectively, the “Service”).

The Service is operated by Jobs Of The West, LLC (“Company,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree, you may not use the Service.


1. Nature of the Service
The Service is an online hiring marketplace connecting job seekers and employers in agriculture and western industries.

The Service includes, without limitation:
- Job listings
- Internship listings
- Searchable resume database
- In-platform messaging
- Employer hiring services
- Consulting services
- Digital downloads
- Directory memberships
- Event promotions

We are not an employer, recruiter, staffing agency, or agent of any user. We do not guarantee employment, job placement, candidate suitability, or hiring outcomes.

2. Eligibility
You must be at least 18 years old to enter into binding agreements through the Service.

Individuals aged 13–17 may use the Service only with parental or legal guardian permission.
Minors may not enter paid subscription agreements without parental consent.
By using the Service, you represent and warrant that you meet these requirements.

3. Accounts
You must provide accurate, current, and complete information. You are responsible for:
- Maintaining account confidentiality
- All activity under your account
- Any use of your login credentials

We may suspend or terminate accounts at any time, with or without notice, for violation of these Terms. No refunds will be issued upon termination.

4. Employer Terms

4.1 Compliance With Laws
Employers represent and warrant that:
- All job postings comply with federal, state, and local employment laws
- No discriminatory practices are promoted
- Compensation structures are lawful and clearly disclosed
- Listings are truthful and accurate
- No fraudulent, deceptive, or misleading opportunities are posted

We do not verify employers. We reserve the right to remove listings at our sole discretion.

4.2 Resume Database Access
Employers may search the resume database only while maintaining at least one active job listing. Resume data may be used solely for legitimate hiring purposes.

Employers may not:
- Scrape or harvest resume data
- Build independent candidate databases
- Resell, redistribute, or transfer candidate data
- Use automated tools to extract information
- Use resume data for marketing unrelated to hiring

Access may be revoked immediately for violations.

4.3 Messaging
Employers may message candidates, including cold outreach to searchable database users. Employers are solely responsible for communications. Harassment, spam, and solicitation unrelated to hiring are prohibited.

5. Job Seeker Terms
Job seekers represent and warrant that:
- All submitted information is accurate
- Credentials are truthful
- No impersonation occurs

We do not guarantee employment. We are not responsible for employer conduct. Employers may retain application materials.

6. Job Posting Policy — One Role Per Listing
Each job posting on the Service is valid for one (1) distinct position and remains active for 45 days from the date of publication, unless removed earlier by the employer or the Company.

A “distinct position” is defined as a role that differs in any material way, including but not limited to:

- Location
- Territory/Area Served
- Responsibilities
- Compensation structure
- Reporting structure
- Required qualifications

If you are hiring for the same role across multiple locations or territories, each location or territory must be posted as a separate listing.

6.1 Examples of Separate Listings Required
The following are considered separate roles and require separate job postings:

- Southwest Territory Representative (applicant must reside in Arizona, New Mexico, or Southern Colorado)

- Northwest Territory Representative (applicant must reside in Washington, Northern Idaho or Montana)

Even if the job title and responsibilities are the same, differences in territory constitute separate roles.

6.2 Exception: Multiple Hires for Identical Role
A single listing may be used when hiring multiple individuals for the exact same role, provided all of the following are identical:

- Job title
- Responsibilities
- Location
- Compensation structure
- Reporting structure

Example:
Hiring 5 Trade Show Representatives for the same event, with identical responsibilities and pay, may be posted as one listing.

6.3 Listing Duration and Use
Each job posting is active for 45 days from the date it is published. A job listing may not be reused, reassigned, or modified to represent a different role once it has been published.

If a position is filled before the 45-day period ends:
- The listing must be removed or marked as filled.
- The remaining time may not be transferred to a new or different role.
- The listing may not be edited to advertise a new position.

6.4 Prohibited Listing Practices
Employers may not:
- Combine multiple distinct roles into a single listing
- Change a listing to a different role after publication
- Reuse an active or expired listing for a new position
- Use one listing to cover multiple territories or job variations
- Attempt to extend listing visibility beyond the 45-day period without purchasing a new listing

6.5 Enforcement
Jobs Of The West, LLC reserves the right to:
- Request edits to non-compliant listings
- Remove or unpublish listings at any time
- Require the purchase of additional listings where applicable
- Restrict or suspend employer access for repeated violations
- No refunds will be issued for listings removed due to policy violations.

7. Payments and Subscriptions

7.1 No Refund Policy
All payments are final. We do not offer refunds for:
- Job listings
- Subscriptions
- Consulting services
- Resume services
- Digital downloads
- Directory memberships

7.2 Auto-Renewal
Subscriptions renew automatically unless cancelled through the dashboard prior to renewal.
No prorated refunds are provided.

7.3 Unlimited + Concierge Annual Commitment
Monthly Unlimited + Concierge subscriptions require a 12-month commitment.

If cancelled before completion of the 12-month term:
- The remaining balance of the annual commitment becomes immediately due
- We may charge the payment method on file

7.4 Directory Memberships
Annual Directory memberships are paid in full up front.
No refunds are issued for early cancellation.

7.5 Payment Processing
Payments are processed through third-party processors, including Stripe and PayPal.
We do not store full payment card numbers.

8. Anti-Scraping and Automated Access
You may not:
- Use bots or automated systems
- Scrape data
- Harvest email addresses
- Reverse engineer the platform
- Circumvent security controls
- Bypass rate limits
- Attempt to access restricted areas

Violation may result in immediate termination and legal action.

9. Intellectual Property
The Service, including all software, design, branding, and database structure, is owned by Jobs Of The West, LLC. You may not copy, reproduce, distribute, or create derivative works without permission.

10. Indemnification
You agree to indemnify and hold harmless Jobs Of The West, LLC from any claims arising out of:
- Employment law violations
- Discriminatory practices
- Misuse of resume data
- False statements in postings or resumes
- Intellectual property infringement
- Violation of these Terms

11. Limitation of Liability
To the maximum extent permitted by law, our total liability shall not exceed the greater of:
- $100
- The total amount paid by you to the Company in the 12 months preceding the claim

We are not liable for:
- Hiring outcomes
- Employer conduct
- Candidate misrepresentation
- Lost profits
- Indirect or consequential damages

12. Arbitration and Dispute Resolution
All disputes shall be resolved by binding arbitration in Elmore County, Idaho.
Idaho law governs these Terms. You waive:
- The right to a jury trial
- The right to participate in a class action

Each party shall bear its own legal fees unless otherwise required by law.

13. Termination
We may suspend or terminate access immediately, with or without notice. No refunds will be issued upon termination.

14. Changes to Terms
We may update these Terms at any time. Continued use after changes constitutes acceptance.

15. Privacy
Jobs Of The West, LLC takes the privacy of all users seriously.

All sessions, employer accounts, job listings, and applicant information are treated as confidential and are not shared with third parties for marketing or commercial purposes.
Email addresses and contact information collected through the Service are used solely for platform-related communications and are not sold, rented, or transferred to outside parties.
Employers may only use applicant contact information for legitimate hiring purposes directly related to the role for which the applicant applied. Use of applicant data for any other purpose is prohibited and may result in immediate account suspension.
Consulting and strategy session content is confidential. We do not share session details, materials exchanged, or outcomes with any third party.

This section is a summary. Our full Privacy Policy governs the collection, use, and storage of personal data. In the event of conflict between this summary and the Privacy Policy, the Privacy Policy controls

16. Purchaser Terms
The following terms apply to all purchasers of paid products and services. By completing a purchase, you agree to the terms applicable to your product type.

16.1 Resume Writing Services
"Your 72-business-hour turnaround window begins when we receive your completed intake form, not at the time of purchase. The intake form will be sent to you via email after purchase. It is your responsibility to complete and return it promptly.

Your purchase includes one (1) resume — either a general resume you can tailor for future roles, or a role-specific resume for a position you are actively applying to, as indicated in your intake form.

Additional role-specific resumes are available at $50 per role. Prior purchase of resume services does not entitle you to additional resumes at a discounted rate. Each resume requires a separate purchase regardless of the client's history.

Deliverable Acceptance: Once your resume draft is delivered, you have 72 business hours to review and respond with requested changes. If we do not hear from you within that window, your project will be considered complete and closed. We cannot hold your place in the queue for revision requests made after that time.

60-Day Interview Guarantee: If you have not received an interview within 60 days of receiving your completed resume, we will rework it at no charge, subject to the following:

* You must provide a complete list of positions applied to during the 60 days, along with the resume version used for each application.

* The positions applied to must be within the industry, role type, and experience level the resume was written. Applications submitted for positions outside that scope do not qualify for this guarantee.

* This guarantee covers one (1) rework and does not entitle you to a refund or ongoing revisions.

No refunds are issued for resume services. We do not guarantee interviews, offers, or employment outcomes.

16.2 The Ag and Western Career Blueprint
The Blueprint is a digital download product delivered electronically upon purchase. All sales are final. No refunds are issued.

The Blueprint is licensed for individual, personal use only. It is non-transferable and may not be:
* Shared, forwarded, or distributed to any other person
* Reproduced or republished in whole or in part
* Resold or redistributed in any format
* Used in any commercial context without express written permission from Jobs Of The West, LLC

Unauthorized sharing or redistribution constitutes a violation of these Terms and may result in account termination. No one-on-one support or coaching is included with the Blueprint. Results are not guaranteed.

16.3 Individual Employer Job Listings
All listing purchases are final. No refunds are issued, including for listings removed due to policy violations.

Applicant Assurance: If your listing receives zero applicants during its active 45-day period, we will repost it at no charge, subject to the following:

* Applicants must have applied through the platform. Applications submitted off-site, via phone, or through any channel outside the Service do not count.
* You must allow us to review and, if necessary, optimize your job description before reposting. This step is required. Listings that have not been reviewed by our team are not eligible for a free repost.
* This applies to one (1) free repost per original listing. It does not apply to listings removed, unpublished, or marked filled before the 45-day period ended.

We do not guarantee applicant volume, candidate quality, or hiring outcomes.

16.4 Unlimited+ Concierge Subscription
The Unlimited+ Concierge plan is available monthly ($375/month) or annually ($3,300/year, paid in full). Both options constitute a 12-month commitment.

Subscriptions renew automatically. Monthly subscribers are charged on the same date each month. To avoid being charged, you must cancel before your next scheduled billing date. Charges already processed are not refundable.

If you cancel a monthly subscription before completing the 12-month term, the full remaining balance of the annual commitment becomes immediately due. We reserve the right to charge the payment method on file for that balance.

If you did not cancel before your renewal date and a charge was processed, any refund request will be considered at our sole discretion and will be reduced by any payment processing fees we cannot recover.

Results are not guaranteed.

16.5 Directory Memberships
Directory memberships are available monthly ($34.99/month) or annually ($299/year, paid in full upfront). Memberships renew automatically.

To avoid being charged, you must cancel before your next scheduled billing date. No prorated refunds are issued for early cancellation of annual memberships.

If you did not cancel before your renewal date and a charge was processed, any refund request will be considered at our sole discretion and will be reduced by any payment processing fees we cannot recover.

16.6 Career Consulting and Business Strategy Sessions
Sessions must be scheduled and completed within six (6) months of purchase. Sessions not used within that window are forfeited without refund.

If you are more than 10 minutes late to a scheduled session, you will be considered a no-show. No-show sessions are forfeited and are not eligible for rescheduling or refund.

Rescheduling requires at least 24 hours' notice via email. Requests made with less than 24 hours' notice may be treated as a no-show at our discretion.

All session content and materials shared are confidential. Sessions must be scheduled through our official booking process. Requests made through any other channel do not constitute a confirmed appointment.

No refunds are issued for consulting or strategy sessions. Results are not guaranteed.

16.7 Chargebacks and Payment Disputes
Before initiating a chargeback or payment dispute with your bank or card issuer, you agree to contact us first at hello@ofthewest.co. We are committed to resolving legitimate concerns directly.

If a chargeback is filed without prior contact, or for a purchase subject to our no-refund policy, we reserve the right to:
* Immediately suspend or terminate your account
* Dispute the chargeback with supporting documentation
* Pursue recovery of the disputed amount plus any fees or costs incurred as a result

Chargebacks filed in bad faith, or for services delivered as described, may be treated as a breach of these Terms.

16.8 Communications Policy
All service-related requests, scheduling, revision requests, and support inquiries must be submitted via email to hello@ofthewest.co. Messages sent through social media, text, phone, or any other channel are not considered official requests and will not be acted upon unless confirmed in writing via email. Jobs Of The West, LLC does not make binding commitments outside of email correspondence.

16.9 Governing Document
In the event of conflict between these Terms and any information on a marketing page, social media post, email campaign, or verbal conversation, these Terms govern.
